Anti-discrimination Law

Anti-discrimination law in Australia includes:

  • sex discrimination and sexual harrassment
  • racial discrimination
  • disability discrimination

Australia has a two-tiered system of anti-discrimination law.

Under the Federal system, complainants may lodge a complaint of discrimination with the Australian Human Rights Commission, which is a Federal Government body.  The Commission seeks to settle the complaint by conciliation; however if it does not settle then the complaint is referred to the Federal Magistrates Court to be resolved by a court hearing.

Under the State system, complainants may lodge a complaint of discrimination with one of the State-based anti-discrimination bodies. In New South Wales this is the Anti-Discrimination Board of New South Wales.  The Board also seeks to settle the complaint by conciliation; however if it does not settle then the complaint is referred to the Equal Opportunity Division of the Administrative Decisions Tribunal of New South Wales to be resolved by a hearing.
